BCN SHOP – TERMS AND CONDITIONS OF SALE

1. ABOUT US
These Terms and Conditions apply to purchases made from BCN Shop, BCN Promo and associated BCN online stores operated by:

Booking Online Ltd t/a BCN (Bouncy Castle Network) is referred to throughout these Terms as “BCN”, “we”, “us” or “our”.
We supply products and services primarily to businesses operating within the inflatable, leisure, events and party-rental industries. Our products and services include printed promotional products, customised printed products, artwork and graphic design services, marketing materials, accessories, inflatable cleaning products and other related goods.
Our online store is powered by Shopify.
By placing an order with BCN, you agree to these Terms and Conditions together with any policies referred to on our website.
Nothing within these Terms affects any statutory rights which cannot legally be excluded or restricted.
2. BUSINESS AND CONSUMER CUSTOMERS
Many BCN customers purchase products in connection with a business, trade or profession.
Where you purchase from BCN wholly or mainly for purposes relating to your trade, business, craft or profession, you will be treated as a Business Customer.
Where you purchase wholly or mainly outside your trade, business, craft or profession, you may be treated as a Consumer and additional statutory consumer protections may apply.
Where these Terms distinguish between Business Customers and Consumers, the relevant provisions will apply accordingly.
3. PLACING AN ORDER
When you place an order, you are making an offer to purchase the products or services selected.
An order is accepted when we confirm that we have accepted it or begin providing the ordered goods or services.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- • a product has been incorrectly priced;
• information on our website contains an obvious error;
• a product is unavailable;
• we are unable to complete the requested design or print work;
• artwork supplied is unsuitable;
• we reasonably believe the requested work may infringe another person's intellectual property rights;
• the requested content is illegal, defamatory or otherwise inappropriate; or
• payment has not been successfully received.
Where we cancel an order before supplying any goods or services, amounts paid for the cancelled element will normally be refunded.
4. PRICES AND PAYMENT
Prices displayed on our website are those applicable at the time an order is placed unless an obvious pricing error has occurred.
VAT will be applied where applicable.
Delivery charges and other applicable charges will be displayed during checkout or included within the relevant quotation.
Full payment may be required before artwork, design or production begins.
Where additional work is requested outside the scope of the original order, BCN may charge an additional design, production or administration fee.
5. DESIGN SERVICES AND REVISIONS
BCN provides graphic design and artwork services including, but not limited to:
- Logo design;
- Leaflet design;
- Business card design;
- Banner design;
- Roller banner artwork;
- Safety leaflet artwork;
- Social media graphics;
- Facebook cover and share images;
- Website banners;
- Promotional artwork;
- Crash mat artwork;
- Disclaimer pad artwork; and
- Other bespoke design services.
Unless expressly stated otherwise on the relevant product or quotation, each BCN design service includes up to three rounds of revisions to the design presented.
A revision means reasonable amendments to the existing design based upon the original brief. A request for a substantially different design, new concept or significant change to the original brief may be treated as additional design work rather than a revision.
Customers should therefore provide as much information as possible when submitting their initial design brief.
ADDITIONAL REVISIONS
Once the three included rounds of revisions have been used, any further design work will be charged at BCN's standard design rate of £40.00 per hour.
Where additional chargeable work is required, BCN will advise the customer before undertaking that additional work.
Additional design charges may also apply where the customer substantially changes the original brief after design work has commenced.
6. DESIGN BRIEFS AND CUSTOMER INFORMATION
Customers are responsible for providing BCN with accurate information and a sufficiently clear brief.
This includes checking information such as:
- Business names;
- Telephone numbers;
- Email addresses;
- Website addresses;
- Social media details;
- Prices;
- Dates;
- Addresses;
- Safety information;
- Legal wording;
- QR codes;
- Product specifications; and
- Spelling and grammar specific to their business.
BCN may identify obvious mistakes during the design process but does not provide a professional proofreading, legal verification or regulatory compliance service unless expressly agreed otherwise.
It remains the customer's responsibility to ensure that all information appearing within their design is accurate and appropriate for its intended use.
7. ARTWORK PROOFS AND FINAL APPROVAL
Where BCN provides an artwork proof, the customer must check the proof carefully before approving it.
The customer is responsible for checking:
- Wording;
- Spelling;
- Grammar;
- Telephone numbers;
- Addresses;
- Dates;
- Prices;
- Website addresses;
- Email addresses;
- Layout;
- Positioning;
- Photographs;
- Logos;
- Colours;
- QR codes;
- Dimensions; and
- The overall appearance of the design.
Approval of an artwork proof constitutes the customer's final confirmation that the design is correct and ready for production.
Once artwork has been approved and submitted for printing or production, that approval is final and production may commence immediately.
The customer accepts responsibility for any error, omission or design element that was visible within the approved artwork.
BCN will have no obligation to provide a free reprint, replacement or refund because of an error or design element that appeared within artwork approved by the customer prior to printing.
This includes, but is not limited to:
- Spelling mistakes;I
- Incorrect telephone numbers;
- Incorrect website or email addresses;
- Incorrect dates;
- Incorrect prices;
- Incorrect wording;
- Positioning or layout;
- Photographs or images;
- Logos;
- QR codes;
- Customer-requested design choices; and
- Colour differences falling within the tolerances described within these Terms.
Where the customer requests changes after artwork has been approved but before production has commenced, BCN will attempt to accommodate the request but cannot guarantee that production can be stopped.
Where production has already commenced, the customer may be required to place and pay for a new order.
This clause does not apply where BCN introduces an error after the final artwork has been approved or where the finished goods are otherwise defective in a manner for which BCN is legally responsible.
8. CHANGES AFTER APPROVAL
Once artwork has been approved, BCN is entitled to proceed with production without obtaining any further confirmation from the customer.
Customers should therefore not approve artwork until they are completely satisfied that it is ready to print.
Once an approved design has been sent into production, the order cannot normally be changed, cancelled or amended.
If production can be stopped, BCN may charge for:
- Design work already completed;
- Administration;
- Print preparation;
- Materials already used;
- Third-party production costs; and
- Any costs associated with restarting or amending the order.
If the product has already been printed or manufactured, any requested alteration will require a new order at the customer's expense.
9. CUSTOMER-SUPPLIED ARTWORK
Where customers supply their own print-ready artwork, they are responsible for ensuring that it is suitable for the required product.
This includes appropriate:
- Dimensions;
- Resolution;
- Bleed;
- Margins;
- File format;
- Image quality;
- Fonts;
- Colour profiles; and
- Print quality.
BCN may make minor technical adjustments where reasonably required for production but is not responsible for poor-quality output resulting from poor-quality, low-resolution or incorrectly prepared files supplied by the customer.
Where customer artwork requires significant correction or reconstruction, additional artwork charges may apply.
10. CUSTOMER-SUPPLIED LOGOS, PHOTOGRAPHS AND INTELLECTUAL PROPERTY
By supplying BCN with logos, photographs, illustrations, trademarks, wording or other content, you confirm that you own the material or have permission to use it for the requested purpose.
You authorise BCN and its production partners to reproduce that material solely as reasonably necessary to fulfil your order.
You must not ask BCN to reproduce material which infringes another person's copyright, trademark or other intellectual property rights.
Business Customers shall be responsible for reasonable losses, costs or claims incurred by BCN as a direct result of BCN reproducing material supplied by the customer where the customer did not have the necessary rights or permission to use that material.
11. OWNERSHIP OF BCN DESIGN WORK
Unless expressly agreed otherwise, BCN retains ownership of its working files, templates, design methods, layouts, concepts and editable/source artwork.
Once an order has been paid for in full, the customer is granted the right to use the final supplied design for the purpose for which it was commissioned.
Editable design files and working/source files are not automatically included unless expressly stated as part of the product or service.
LOGO DESIGN
Where BCN expressly sells a service as a bespoke logo design service and agrees that ownership of the final original logo design will transfer to the customer, such transfer will apply following payment in full and will exclude any third-party fonts, stock imagery, licensed assets or other materials which cannot legally be transferred.
Any specific intellectual-property assignment required beyond this may be confirmed separately in writing.
BCN may display completed work within its portfolio, website, social media, exhibitions or promotional material unless confidentiality has been expressly agreed beforehand.
12. PRINTED PRODUCTS AND PRINTING TOLERANCES
Printed products supplied by BCN can include:
- Leaflets;
- Business cards;
- Banners;
- Roller banners;
- Safety notices;
- Disclaimer pads;
- Promotional material;
- Printed accessories; and
- Other customised products.
Commercial printing is a manufacturing process and minor differences between the digital artwork displayed on screen and the physical printed product are normal.
Minor manufacturing variations can also occur between separate print runs.
These can include reasonable variations in:
- Colour;
- Shade;
- Print density;
- Positioning;
- Trimming;
- Dimensions;
- Finishing;
- Material;
- Alignment; and
- Overall appearance.
Such reasonable manufacturing tolerances will not constitute a printing defect where they do not materially affect the intended use of the product.
13. COLOUR REPRODUCTION AND COLOUR VARIATION
Customers should be aware that colours viewed on a computer monitor, tablet or mobile telephone are produced differently from colours created through a commercial printing process.
The appearance of a colour can also vary depending upon:
- The customer's screen;
- Screen brightness and calibration;
- RGB to CMYK conversion;
- The printing process;
- Ink;
- Substrate or material;
- Finishing;
- Printer calibration; and
- Production batch.
For these reasons, the colours displayed within a digital proof are intended as a visual representation of the finished product and should not be treated as an exact colour-match guarantee.
15% COLOUR TOLERANCE
Unless a specific colour-matching requirement has been agreed with BCN before production, printed colours may vary by up to approximately 15% from the colour appearance presented within the digital artwork or from previous production runs.
This may include variations in:
- Shade;
- Tone
- Brightness;
- Saturation; and
- Print density.
Colour variation falling within this tolerance will not normally be regarded as a printing defect and BCN will not be responsible for providing a free reprint solely because of such variation.
PANTONE COLOURS
Where an exact brand colour is important, the customer should provide the relevant Pantone colour reference before artwork is approved and production begins.
Pantone colour matching is only applicable where BCN has confirmed that the particular product and printing process supports Pantone colour reproduction.
If no Pantone colour has been supplied and specifically agreed, BCN will produce the artwork using the colour values contained within the approved design and the normal printing tolerances described above will apply.
14. PERSONALISED AND BESPOKE PRODUCTS
Many BCN printed products are created specifically for an individual customer and may include that customer's:
- Business name;
- Branding;
- Logo;
- Photographs;
- Contact details;
- Artwork; or
- Other personalised information.
Once production of a personalised or bespoke product has commenced, it cannot normally be cancelled simply because the customer has changed their mind.
Personalised or custom-made products cannot normally be returned for a change-of-mind refund.
This does not affect a customer's statutory rights where goods are faulty, materially not as described or BCN has otherwise failed to fulfil its legal obligations.
15. CANCELLATION OF DESIGN SERVICES
Design work may begin shortly after an order is placed.
Where a Consumer asks BCN to begin a design or other service during a statutory cancellation period, the customer expressly requests that BCN begins providing the service immediately.
Where permitted by law, if the customer subsequently cancels after work has begun, BCN may charge a proportionate amount for the work completed up to the point of cancellation.
Where the service has been fully completed following the customer's express request for work to begin during the cancellation period, the statutory right to cancel may end where permitted by law.
Business Customers do not have an automatic cooling-off period unless BCN expressly agrees otherwise.
16. NON-PERSONALISED GOODS AND RETURNS
Where a Consumer purchases standard, non-personalised goods online, statutory cancellation rights may apply.
If applicable, the Consumer must notify BCN of their decision to cancel within the required statutory period.
Returned products should be properly packaged and returned in an appropriate condition.
Where goods have been handled beyond what would reasonably be necessary to establish their nature, characteristics and functioning, BCN may make any deduction from the refund permitted by law.
Business Customer returns are accepted only where expressly agreed by BCN or where required by law.

17. INFLATABLE CLEANING PRODUCTS
BCN supplies professional cleaning products including cleaner intended for use within the inflatable and event-hire industry.
Customers must follow all product instructions, warnings, dilution ratios and usage directions.
ALWAYS TEST BEFORE USE
Inflatable materials, paints, inks, printed artwork, digital prints, coatings and adhesives can vary considerably depending upon:
- manufacturer;
- age;
- condition;
- printing method;
- ink;
- previous chemical exposure;
- UV exposure
- surface coating;
- previous cleaning products; and
- general wear and deterioration.
BCN strongly recommends that the cleaner is ALWAYS tested on a small, inconspicuous area before being applied to the main surface or artwork.
It is the customer's responsibility to satisfy themselves that the cleaning product is suitable for the particular material, inflatable, artwork or surface being cleaned.
Particular care should be taken around:
- printed artwork;
- digitally printed panels;
- painted artwork;
- older inflatables;
- faded surfaces;
- decals;
- stickers;
- adhesives;
- repaired areas;
- damaged material;
- specialist coatings; and
- areas where the inflatable manufacturer specifies particular cleaning restrictions.
DAMAGE TO MATERIAL OR ARTWORK
BCN cannot determine the composition, age, condition, print process, chemical resistance or previous treatment of every inflatable or surface upon which its cleaning products may be used.
Accordingly, successful use on one inflatable or printed surface does not guarantee identical results on another.
To the fullest extent permitted by law, BCN will not be responsible for fading, staining, discolouration, deterioration, lifting, bleeding, removal or other damage to inflatable material, artwork, inks, graphics, coatings, adhesives or printed surfaces where this results from circumstances including:
- failure to test the cleaner on an inconspicuous area before use;
- failure to follow product instructions;
- incorrect dilution;
- excessive concentration;
- excessive application;
- leaving cleaner on a surface for longer than recommended;
- use on an unsuitable material;
- use on unstable or incompatible inks;
- use on aged or deteriorated artwork;
- mixing the product with other cleaning chemicals;
- use contrary to an inflatable manufacturer's instructions;
- pre-existing deterioration or damage;
- previous chemical treatment; or
- misuse of the product.
The customer is responsible for checking compatibility before applying the product to the full inflatable or printed area.
Nothing within this section excludes or restricts any liability which BCN cannot lawfully exclude.
18. PRODUCT DESCRIPTIONS
BCN makes reasonable efforts to ensure product descriptions, dimensions, photographs and specifications are accurate.
Photographs and visual representations are provided for guidance.
Manufacturers and suppliers may occasionally make minor specification, packaging, material or appearance changes without prior notice.
BCN may therefore supply a product containing minor differences from website imagery where those differences do not materially alter the nature, quality or intended function of the product.
19. PRODUCTION AND DELIVERY TIMES
Any production or delivery times displayed on our website or provided by our staff are estimates unless BCN expressly confirms that a particular deadline is guaranteed.
For customised printed products, production time normally begins once:
1. all required information has been received;
2. any required artwork has been completed;
3. the customer has approved the final proof; and
4. payment requirements have been satisfied.
Delays in supplying information or approving proofs will delay production.
BCN is not responsible for delays caused by circumstances reasonably outside our control, including courier disruption, supplier delays, severe weather, strikes, machinery failure, transport disruption or other exceptional events.
Nothing in this section removes any statutory rights applicable to Consumers concerning delivery.
20. DELIVERY
Customers are responsible for supplying a complete and accurate delivery address.
BCN is not responsible for additional costs or delays caused by incorrect or incomplete delivery details supplied by the customer.
Customers should inspect deliveries promptly.
Business Customers should notify BCN as soon as reasonably possible if:
- goods have been damaged in transit;
- items are missing;
- the quantity is incorrect; or
- there is an obvious manufacturing fault.
Where practical, photographs of the packaging and goods should be retained to assist us in investigating a claim.
Risk in the goods passes to the customer when the goods are delivered to the customer or another person nominated by them, subject to any different mandatory legal rule which applies.
21. PRINTING ERRORS, APPROVED ARTWORK AND REPRINTS
Customers must inspect printed goods as soon as reasonably possible after delivery.
If the finished product materially differs from the final artwork approved by the customer because of a production error, the customer should contact BCN promptly and provide photographs where reasonably requested.
BCN will investigate the issue and, where appropriate, provide the remedy required under applicable law.
NO REPRINT FOR CUSTOMER-APPROVED ARTWORK
BCN will not provide a free reprint where the alleged error or issue:
- appeared within the artwork approved by the customer;
- resulted from information supplied incorrectly by the customer;
- resulted from customer-supplied artwork;
- relates to a design choice approved by the customer;
- relates to an expected printing or manufacturing tolerance; or
- relates solely to colour variation falling within the stated colour tolerance.
Once the customer has approved the final design and that design has been submitted for printing, responsibility for checking the content and design passes to the customer.
Approval therefore means:
“I have checked this artwork, I am happy for it to be printed, and I accept responsibility for the content and design shown.”
BCN is not responsible for the cost of reprinting an order because a customer subsequently notices something within the artwork which they had previously approved.
This does not affect liability for a printing or production fault introduced after approval or any statutory rights which cannot legally be excluded.
22. CONSEQUENTIAL BUSINESS LOSS
This section applies to Business Customers.
BCN shall not be liable for indirect or consequential business losses arising from a product, print order, design service or delayed delivery, including:
- loss of profit;
- loss of revenue;
- loss of bookings;
- loss of business;
- loss of opportunity;
- loss of anticipated savings;
- loss of goodwill; or
- consequential costs incurred with third parties.
Customers who require printed material for a specific event or deadline should allow sufficient time for production, delivery and any necessary correction or reprint.
Except where liability cannot legally be limited, BCN's aggregate liability to a Business Customer arising from an individual order shall not exceed the total amount paid to BCN for the particular goods or services giving rise to the claim.
Nothing in these Terms excludes liability which cannot lawfully be excluded or restricted.
23. WEBSITE AND THIRD-PARTY SERVICES
Our website may contain links, integrations or services supplied by third parties.
BCN is not responsible for the content, availability or operation of third-party websites or services.
Customers should review the relevant third party's own terms and privacy information before using those services.
24. SHOPIFY
Our online store is powered by Shopify, which provides the ecommerce technology through which we offer products and services.
Any purchase made through the BCN Shop is a transaction between the customer and BCN, not between the customer and Shopify.
Shopify may process certain information in connection with providing its ecommerce services. Further information is available through our Privacy Policy and Shopify's applicable privacy information.
25. PRIVACY
Personal information submitted to BCN will be handled in accordance with our Privacy Policy and applicable data-protection legislation.
Information may be shared with relevant service providers where necessary to:
- process payments;
- produce orders;
- deliver goods;
- operate our website; or
- provide our services.
26. PROHIBITED USE
Customers must not use BCN's website or services:
- for unlawful purposes;
- to infringe intellectual property rights;
- to submit fraudulent information;
- to transmit malicious code;
- to interfere with our website or systems;
- to scrape or systematically extract BCN content without permission; or
- in any manner which could damage BCN, its customers, suppliers or systems.
We reserve the right to refuse service or restrict access where there is reasonable evidence of misuse.
27. EVENTS OUTSIDE OUR CONTROL
BCN will not be responsible for delay or failure to perform an obligation where the delay or failure results from events reasonably beyond our control.
These may include severe weather, natural disasters, fire, flood, power or communications failures, industrial disputes, courier disruption, supplier failures, transportation problems, government action or other comparable events.
We will make reasonable efforts to minimise disruption where practicable.
28. SEVERABILITY
If any provision within these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue in effect.
29. FAILURE TO ENFORCE
If BCN does not immediately enforce a provision of these Terms, this does not mean that BCN has waived its right to enforce that provision later.
30. CHANGES TO THESE TERMS
BCN may update these Terms from time to time.
The Terms applicable to an order will normally be those in effect at the time the order is placed.
The latest version will be published on our website.
31. GOVERNING LAW
These Terms and any contract between BCN and a Business Customer are governed by the laws of England and Wales.
Business Customers agree that the courts of England and Wales will have exclusive jurisdiction over disputes arising from the contract.
Where the customer is a Consumer, nothing in this clause removes any mandatory rights they may have to bring proceedings in the part of the United Kingdom in which they live or any other rights which cannot legally be restricted.
32. YOUR STATUTORY RIGHTS
Nothing in these Terms is intended to exclude, restrict or replace any rights which a Consumer has under applicable law and which cannot legally be excluded.
Where any part of these Terms conflicts with a mandatory statutory Consumer right, that statutory right will take precedence.
